We manage the mobile application CMN (Charge Me Now), as well as any other associated products and services connected to these legal terms (referred to as the 'Legal Terms') that have been selected by you or your electric vehicle dealer (together known as the 'Services'). By accessing the Services, you acknowledge that you have read, understood, and agreed to comply with all these Legal Terms. IF YOU DISAGREE WITH ANY PART OF THESE LEGAL TERMS, YOU ARE NOT ALLOWED TO USE THE SERVICES, AND YOU MUST STOP USING THEM IMMEDIATELY. Additional terms and conditions or documents that may be published in the Services periodically are explicitly included here by reference. We reserve the right, at our sole discretion, to amend or modify these Legal Terms at any time and for any reason. Notification of any changes will be provided by updating the 'Last updated' date of these Legal Terms. It is your responsibility to regularly review these Legal Terms to stay informed of any updates. By continuing to use the Services after the posting of any revised Legal Terms, you will be considered to have accepted the changes. All users who are minors in their jurisdiction (usually under the age of 18) must obtain permission from, and be directly supervised by, their parents or guardians to use the Services. If you are a minor, your parent or guardian must read and agree to these Legal Terms before you can use the Services.
By using the Services provided by Charge Me Now, you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, you may not access or use our Services.
2. Description of Services:
Charge Me Now provides mobile EV charging stations and roadside assistance for electric vehicles. Our services aim to assist EV owners in recharging their vehicles conveniently and providing roadside support in case of emergencies or technical difficulties.
Limited to Broward County area.
Our services are primarily conducted in covered car parks. However, services will not be carried out in open outdoor areas during rainy conditions.
Charging operations must adhere to all traffic and safety regulations.
We will address any damage caused during our services, excluding those resulting from manufacturer defects.
Each service package is tied to a CMN registered member and cannot be transferred to someone else.
Charges below 20 kWh will be calculated based on emergency recovery rates.
Charging will cease at 80% of the vehicle's battery capacity to maintain battery efficiency.
All bookings must be made through the designated App.
It is advisable to provide at least 60 minutes' notice for cancellations. Failure to do so will result in the full booking charge.
Please ensure that parked vehicles are easily accessible and preferably under shelter.
It is recommended to remain reachable during charging in case access to the vehicle is necessary.
Following each service, you will be provided with a breakdown of charges, including consumed kWh and additional services. Payment or credit deduction will only occur upon completion of the service.
To access certain features of our Services, you may be required to register an account. You agree to provide accurate and complete information during the registration process and to keep your account information up to date. You are responsible for maintaining the security of your account and are solely responsible for any activity that occurs under your account.
- a. You agree to provide accurate and up-to-date information when using our Service.
- b. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- c. You agree not to use the Service for any illegal or unauthorized purpose.
- a. Your CMN Subscription is tied to you, not your vehicle. You can access our services even when you're a passenger in another vehicle. However, non-members who drive your vehicle are not eligible for our services. Please note that our services are not available if the vehicle is uninsured or inoperable before subscribing.
- b. Charge Me Now provides mobile EV charging services at designated locations or upon request.
- c. The availability of charging stations may vary depending on location and demand.
- d. We strive to ensure the quality and safety of our charging stations, but we do not guarantee uninterrupted or error-free charging services.
You have the option to enhance your Subscription coverage at any time, but certain conditions may apply:
. Upgrading your Subscription is subject to the availability of the remaining Service.
. Upgraded benefits take effect 48 hours after the upgrade is purchased.
. Upgraded benefits do not extend to any existing issues with your vehicle.
. Any additional charges associated with your Account will be your responsibility.
- a. Charge Me Now offers roadside assistance services to EV owners.
- b. Roadside assistance is subject to availability and may vary depending on location and circumstances.
- c. To access our Services, your presence alongside the vehicle and verification of your subscription are required on-site. Our assistance is only provided when you're physically present with the vehicle, and it's restricted to the individual designated on the subscription. Before roadside assistance Services are rendered, you must present personal identification, which must match the CMN account holder's information on record. New subscribers needing immediate assistance will incur a one-time fee of $125 for their initial request. The Roadside Assistance Service is not available for vehicles with existing issues. Additional charges may arise for waiting or standby time. Initially, Roadside Assistance Service offers Basic coverage of up to 10km, irrespective of the subscription level chosen by new subscribers.
- a. The use of our Services may involve charges, which will be clearly communicated to you before you incur them. By using our Services, you agree to pay all applicable charges associated with your use of the Services. Charges may vary based on factors such as distance traveled, duration of use, and additional services requested.

- c. Payment methods accepted will be clearly outlined on our platform
Your subscription with Charge Me Now lasts for one year and will automatically extend for another year unless you inform us of your cancellation before the anniversary of your subscription. It's important to note that you cannot cancel your subscription midway through the term.
You have the choice to pay for your subscription upfront for the entire year or opt for monthly payments. If you choose the monthly payment plan, you are responsible for paying the full annual subscription amount.
If subscription fees are not paid within 30 days after the expiry date, your subscription will be considered lapsed. If payment is made between 30 and 90 days after expiry, you can retain your original expiry date and any associated discounts. However, if you require Roadside Assistance during a lapsed subscription, you will need to pay a "1 Time Request" fee. Payment after 90 days will be treated as a new subscription.
You can modify your subscription, including upgrades, downgrades, or changes to payment methods, by accessing your account settings on the Charge Me Now mobile app or by contacting our customer support.
Subscription prices may change at any time. Charge Me Now reserves the right to adjust subscription fees, providing prior notice to subscribers as required by law.

While we strive to provide reliable and uninterrupted Services, we do not guarantee that our Services will always be available. We may suspend or terminate the provision of our Services without prior notice for any reason, including maintenance, upgrades, or unforeseen circumstances.
You agree to use our Services in compliance with all applicable laws and regulations. You further agree not to engage in any activity that may interfere with or disrupt the proper functioning of our Services or that may harm or compromise the security of our systems or other users.
All content and materials available through our Services, including but not limited to logos, trademarks, and software, are the property of Charge Me Now LLC or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from our Services without prior written permission.
This Mobile Application License Agreement ("Agreement") is a legal agreement between you and Charge Me Now LLC ("Licensor") for the use of the Charge Me Now mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this Agreement.
When utilizing the App acquired from either the Apple Store or Google Play (each referred to as an 'App Distributor') to access the Services, the following conditions are applicable:
- a. The license granted to you for our App is restricted to a non-transferable license allowing you to utilize the application on a device running either the Apple iOS or Android operating systems, as appropriate, and in accordance with the usage regulations specified in the applicable App Distributor’s terms of service.
- b. We are responsible for providing any necessary maintenance and support services for the App as outlined in the terms and conditions of this mobile application license included in these Legal Terms or as mandated under applicable law. You acknowledge that each App Distributor is not obligated to provide any maintenance and support services for the App.
- c. If the App fails to meet any applicable warranty, you may notify the relevant App Distributor, who, in accordance with its terms and policies, may refund the purchase price, if any, paid for the App. To the fullest extent permitted by applicable law, the App Distributor will have no other warranty obligations regarding the App.
- . You are not situated in a country subject to a US government embargo or designated by the US government as a 'terrorist supporting' country.
- . You are not included on any US government list of prohibited or restricted parties.
- e. You must adhere to applicable third-party agreements when using the App. For instance, if you use a VoIP application, you must not violate their wireless data service agreement when utilizing the App.
- f. You acknowledge and consent that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license included in these Legal Terms. Each App Distributor will possess the right (and will be considered to have accepted the right) to enforce the terms and conditions in this mobile application license included in these Legal Terms against you as a third-party beneficiary.
Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use on a mobile device owned or controlled by you, in accordance with the terms of this Agreement.
- a. You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the App.
- b. You may not sublicense, lease, rent, loan, distribute, or otherwise transfer the App or any of its rights under this Agreement.
- c. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in the App.
The App and all intellectual property rights therein are owned by Licensor and its licensors. This Agreement does not convey any ownership rights in the App, but only a limited license to use as expressly set forth herein.
Licensor may, from time to time, provide updates, modifications, or new versions of the App. You agree to promptly install and use such updates, modifications, or new versions as they become available.
By using our Service, you agree to the collection and use of your information in accordance with our Privacy Policy, which can be found on our website.
This Agreement is effective until terminated by you or Licensor. You may terminate this Agreement by uninstalling the App and ceasing all use. Licensor may terminate this Agreement at any time without notice if you fail to comply with any term or condition of this Agreement.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
To the maximum extent permitted by law, Charge Me Now shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold Charge Me Now and its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in connection with your use of our Services or your violation of these Terms.
Charge Me Now reserves the right to modify or revise these Terms at any time, and such changes will be effective immediately upon posting. Your continued use of our Services following the posting of any changes to these Terms constitutes acceptance of those changes.
These Terms shall be governed by and construed in accordance with the laws of the state of Florida where Charge Me Now is headquartered, without regard to its conflict of law principles.
The App and all intellectual property rights therein are owned by Licensor and its licensors. This Agreement does not convey any ownership rights in the App, but only a limited license to use as expressly set forth herein.

- a. This Agreement constitutes the entire agreement between you and Licensor regarding the subject matter herein and supersedes all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Licensor regarding the subject matter herein.
- b. By clicking "I agree" or by downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, do not download, install, or use the App.
